These STC B2C apply in addition to the GTC for all contracts concluded between WRO and consumers (within the meaning of the Austrian Consumer Protection Act, Konsumentenschutzgesetz, “KSchG”) regarding the purchase of Tickets and Merchandise via distance contracts through the WRO online shop (“Webshop”).
In accordance with Section 18 (1) no 10 Austrian Act on Distance and Off-Premises Sales (Fern- und Auswärtsgeschäfte-Gesetz, “FAGG”), contracts for the provision of services related to leisure activities are excluded from the right of withdrawal, provided that a specific date or period for performance is stipulated in the contract. As Tickets are issued for a specific date, the statutory right of withdrawal does not apply to the purchase of Tickets.
WRO’s obligations include admitting the Customer to the booked concert event and providing a seat in the agreed seating category. Beyond the concert performance of the concert event, WRO is under no obligation to provide tourist services, transfer services, or parking facilities.
