Scope of Application<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">1.1<\/span> These General Terms and Conditions (\u201cGTC\u201d) form the basis of the legal relationship between Wiener Residenzorchester Veranstaltungs GmbH (\u201cWRO\u201d or the \u201cOrganizer\u201d) and those of its contractual partners who (i) book admission tickets for a public concert event individually (\u201cTickets\u201d) or collectively for a group of persons (\u201cGroup Booking\u201d) or for an exclusive concert event of WRO (\u201cExclusive Concert\u201d), or (ii) visit a concert event of WRO (\u201cConcert Visitors\u201d), or (iii) purchase WRO merchandise (\u201cMerchandise\u201d), or (iv) use WRO\u2019s digital offers, in particular its website www.wro.at (\u201cWebsite\u201d) (collectively: \u201cCustomers\u201d).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">1.2<\/span> In addition to these GTC \u2013 depending on the circumstances of the respective legal relationship \u2013 the following Special Terms and Conditions (\u201cSTC\u201d) apply:\n<ul style=\"list-style-type: none; padding-left: 30px; margin-top: 10px; margin-bottom: 10px;\">\n<li style=\"margin-bottom: 5px;\">STC of WRO for Consumers (\u201cSTC B2C\u201d);<\/li>\n<li style=\"margin-bottom: 5px;\">STC of WRO for Business Customers (\u201cSTC B2B\u201d);<\/li>\n<li style=\"margin-bottom: 5px;\">STC of WRO for Exclusive Concerts (\u201cSTC Exclusive Concert\u201d).<\/li>\n<\/ul>\n<p>In the event of any contradictions, the respective applicable STC shall take precedence.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">1.3<\/span> By using the Website, purchasing Tickets or a Group Booking, booking an Exclusive Concert, purchasing Merchandise, or entering the concert venue, the Customer recognizes these GTC as well as the respectively applicable STC as binding.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 2 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">2. Use of the Website<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.1<\/span> By using the Website, the Customer accepts the terms of use set forth in this Section 2. The use of the Website primarily serves to provide information about the services offered by WRO, to contact WRO, and to purchase Tickets and Merchandise. Any unauthorized use of the Website for purposes other than those intended, such as the systematic reading of data, programs, or prices by means of automated processes (scraping), is prohibited. This also applies to the use of deep links or the embedding of the Website\u2019s content on third-party platforms or websites, unless WRO has given its prior consent.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.2<\/span> The content of the Website (e.g., texts, images, graphics, layouts, programs, videos) is protected by intellectual property rights (in particular by copyright) in favor of WRO or its licensors. Any reproduction, distribution, making available to the public, or other exploitation except as expressly permitted by applicable law requires the prior written consent of WRO (and, if applicable, its licensors).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.3<\/span> WRO endeavors to ensure the greatest possible availability of the Website but is not liable for its constant, uninterrupted, and error-free accessibility. Technical malfunctions, maintenance work, or force majeure do not entitle the Customer to claim damages, provided there is no gross negligence or intentional misconduct on the part of WRO.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 3 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">3. House Rules for Concert Events<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.1<\/span> The following provisions apply to all Concert Visitors. By entering the concert venue, the Concert Visitor accepts these house rules.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.2<\/span> The Organizer exercises domiciliary rights through its staff. The instructions of the staff (e.g., evening service, security) to maintain safety, fire safety, and an orderly conduct of the event must be followed at all times and immediately.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.3<\/span> The Organizer is entitled to expel people who disturb the concert event, harass other Concert Visitors (e.g., through improper behavior, excessive alcohol consumption, or offensive body odor), or otherwise violate the house rules from the venue without entitlement to a refund of the ticket price (or any other claim for compensation).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.4<\/span> Outerwear (coats, jackets, etc.), umbrellas, sticks (excluding walking aids), backpacks, bags, suitcases, and bulky items (pieces of luggage larger than A4 format) may not be taken into the concert hall and must be left at the cloakroom (see Section 5). The Organizer reserves the right to check the luggage of Concert Visitors to ensure safety.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.5<\/span> The Concert Visitor acknowledges that if they arrive late at the venue, admission to the concert hall after the start of the concert performance is only possible between two performance pieces \u2013 in coordination with the Organizer\u2019s staff.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.6<\/span> Public concert performances are generally also accessible to Concert Visitors with limited mobility. Due to the physical layout of the respective concert venue, however, it may be necessary to use an alternative route via the elevator, accompanied by an employee of the Organizer. This may lead to delays in admission to the concert hall. The Organizer can therefore only guarantee timely admission to the concert hall for Concert Visitors with limited mobility if they report to the Organizer\u2019s staff at the venue at least 15 minutes before the start of the event.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.7<\/span> Concert Visitors are strictly prohibited from making video, audio, and\/or video-and-audio recordings at any time during the concert performance, without exception. Mobile phones and other electronic devices must be switched off or set to silent before the start of the event. In the event of a violation, the staff is entitled to warn the Concert Visitors concerned and, if the violation continues, to expel them from the concert hall (in this case, no refund of the ticket price is due).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.8<\/span> By entering the concert venue, while being appropriately informed, the Concert Visitor acknowledges that the Organizer or third parties commissioned by it may create photo, video, audio, and\/or video-and-audio recordings in the context of the event. These recordings may be used by the Organizer without limitation as to time, territory, or scope for customary commercial purposes (in particular for marketing, documentation, and advertising purposes). The Concert Visitor has no claim to remuneration in this regard. WRO ensures that legitimate interests of the Concert Visitor (personality rights) are not unduly compromised. A general objection to the making of recordings at the venue is excluded.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.9<\/span> In addition to the rules set forth in this Section 3, the house rules of the lessor of the concert venue may have to be observed. These remain unaffected by the regulations of these GTC and continue to apply in full. Concert Visitors are obliged to familiarize themselves with and comply with the house rules of the lessor posted at the concert venue. In the event of any inconsistencies between the lessor\u2019s house rules and the rules set forth in this Section 3, the lessor\u2019s specifications shall take precedence.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 4 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">4. Cloakroom<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.1<\/span> Items will be held in safekeeping by the Organizer at the cloakroom upon payment of a fee, against which a cloakroom token will be issued. Handing in certain items is mandatory due to safety regulations (see Section 4.4). In the event of any uncertainty, the assessment of the Organizer\u2019s staff is binding for the question of whether an item must be handed in.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.2<\/span> Liability of the Organizer for valuables kept in bags or clothing (in particular cash, credit cards, keys, jewelry, or electronic devices) is excluded. For the avoidance of doubt, it is noted that (also) the liability for cloakroom items is limited according to the general provision in Section 8 of these GTC.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.3<\/span> In the event of loss of the cloakroom token, the item in question will only be returned after presentation of adequate proof of ownership and, if necessary, only after all other cloakroom items have been distributed to their respective owners. The Concert Visitor is liable for any losses, costs, or damage incurred by the Organizer as a result of the loss of the token.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 5 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">5. Multimedia Elements of the Concert Performance<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.1<\/span> The concert events are in some cases supplemented by video and light effects delivered using elaborate projectors and state-of-the-art technology. The Organizer will provide appropriate prior notice of such multimedia elements in concert events. The Customer acknowledges this multimedia design, where applicable, as an integral yet secondary element of the concert event.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.2<\/span> Persons who are sensitive to rapid light changes, strobe effects, or intense projections due to medical conditions (e.g., epilepsy) visit concert events with multimedia elements at their own risk. The Organizer fulfills its duty of care through adequate information on the Website and by placing warning signs at the entrance. Liability of the Organizer for health consequences due to the use of these multimedia elements is excluded, unless there is gross negligence or intentional misconduct.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.3<\/span> If a temporary technical failure, a delay in the performance due to technical problems (waiting time up to 30 minutes), or the complete failure of some or all multimedia components means that the concert performance can only take place without these multimedia elements, this does not generally entitle the Customer to a reduction in the ticket price or to withdraw from the contract. The core of the Organizer\u2019s service is the classical musical performance.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 6 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">6. Intellectual Property and Related Rights to the Concert Performance<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">6.1<\/span> The entire presentation of the concert performance, in particular the choreography, the stage design, the lighting concept, and the interaction of music and multimedia content, is protected by intellectual property rights and related rights of the Organizer or the artists acting on its behalf.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">6.2<\/span> Any unauthorized reproduction, distribution, making available to the public, or other exploitation of the content of the concert performance, the presentation of the entire concert event, or parts thereof (in particular the audiovisual design) by the Customer is strictly prohibited.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">6.3<\/span> In the event of a violation of the filming or photography prohibition as set forth in Section 3.7, the Customer undertakes to immediately delete the unlawfully recorded material at the Organizer\u2019s request and shall be liable to the Organizer for all damages arising from the infringement of the Organizer&#8217;s intellectual property or related rights.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 7 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">7. Limitation of Liability<\/h2>\n<p>The Organizer is liable for damages caused by intentional misconduct or gross negligence. Liability for damages caused by ordinary negligence, however, is excluded (personal injury is exempt from this exclusion of liability).<\/p>\n<\/section>\n<p><!-- Section 8 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">8. Applicable Law and Jurisdiction<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.1<\/span> Austrian law shall apply, excluding the conflict of law rules of international private law (IPR) as well as the UN Convention on Contracts for the International Sale of Goods (CISG).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.2<\/span> For all disputes arising from or in connection with the contractual relationship between WRO and the Customer, the courts of Vienna shall have exclusive jurisdiction, provided that it is not a consumer transaction within the meaning of Section 14 of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, \u201cKSchG\u201d). For consumers, the statutory rules on jurisdiction shall apply.<\/li>\n<\/ol>\n<\/section>\n<\/article>\n<p>[\/vc_column_text]<div class=\"ult-spacer spacer-6a62a0eca5b3a\" data-id=\"6a62a0eca5b3a\" data-height=\"40\" data-height-mobile=\"30\" data-height-tab=\"30\" data-height-tab-portrait=\"\" data-height-mobile-landscape=\"\" style=\"clear:both;display:block;\"><\/div>[vc_column_text css=&#8221;&#8221;]<\/p>\n<article class=\"agb-container\" style=\"line-height: 1.6; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; color: #333; max-width: 850px; margin: 20px auto; padding: 20px; background-color: #fff; border: 1px solid #eee;\">\n<header style=\"text-align: center; margin-bottom: 40px;\">\n<h1 style=\"font-size: 1.6em; line-height: 1.3; margin-bottom: 10px; color: #000;\">Special Terms and Conditions of<br \/>\nWiener Residenzorchester Veranstaltungs GmbH<br \/>\nfor Consumers (STC B2C)<\/h1>\n<p style=\"font-weight: bold; color: #666;\">As of: 16.07.2026<\/p>\n<\/header>\n<p><!-- Section 1 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">1. Scope of Application<\/h2>\n<p>These STC B2C apply in addition to the GTC for all contracts concluded between WRO and consumers (within the meaning of the Austrian Consumer Protection Act, Konsumentenschutzgesetz, \u201cKSchG\u201d) regarding the purchase of Tickets and Merchandise via distance contracts through the WRO online shop (\u201cWebshop\u201d).<\/p>\n<\/section>\n<p><!-- Section 2 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">2. Purchase of Tickets and Merchandise in the Webshop<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.1<\/span> The presentation of Tickets and Merchandise on the Website serves exclusively for informational purposes and does not constitute a binding offer by WRO regarding the actual availability of these products (invitatio ad offerendum).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.2<\/span> A purchase in the Webshop is concluded through the following steps: The offer to conclude a purchase contract originates from the customer by completing the steps provided in the Webshop ordering process and finally clicking the button \u201cconfirm &amp; pay\u201d.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.3<\/span> During this electronic ordering process, the Customer is given the opportunity to review and correct the entries made (number of tickets, date, seat category, etc.) at any time via a standard correction tools (e.g., navigation or editing functions) before submitting their offer. Any input errors discovered after the order has been placed are the sole responsibility of the Customer.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.4<\/span> Immediately upon receipt of the Customer\u2019s order, WRO will send an automatic electronic confirmation to the email address provided by the Customer during the ordering process.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.5<\/span> The purchase contract is concluded when WRO accepts the Customer\u2019s offer. This is done by (a) the electronic transmission of a notice of acceptance (booking confirmation by email) or the delivery of the ordered tickets, or (b) by actual charge to the Customer&#8217;s payment method. Until this point, WRO reserves the right to reject the Customer\u2019s order without stating reasons, particularly in cases of overbooking, technical errors, or evident misuse or abuse by the Customer.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.6<\/span> The contract documents (customer order, terms and conditions, order confirmation) are stored by WRO. The terms and conditions are available to the Customer on the Website. WRO recommends that the Customer save the order confirmation and the applicable Terms and Conditions electronically or print them for their records.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.7<\/span> Tickets are issued in digital form. The Customer receives the digital ticket via email upon conclusion of the contract. Delivery will generally take place within 24 hours of conclusion of the contract. The Customer must have the technical requirements (smartphone, a valid and active email account, PDF reader, printer if applicable) to access, save, or (if desired by the customer) print the digital ticket. WRO accepts no liability for the incorrect or failed display on the Customer&#8217;s device. The customer bears sole responsibility for the correct provision of their email address during the ordering process and must ensure that emails can actually be received at this address (checking the spam folder). Furthermore, the Customer is responsible for downloading the digital ticket in a timely manner, saving it on a mobile device, or printing it in a legible form.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 3 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">3. Right of Withdrawal for Tickets<\/h2>\n<p>In accordance with Section 18 (1) no 10 Austrian Act on Distance and Off-Premises Sales (Fern- und Ausw\u00e4rtsgesch\u00e4fte-Gesetz, \u201cFAGG\u201d), contracts for the provision of services related to leisure activities are excluded from the right of withdrawal, provided that a specific date or period for performance is stipulated in the contract. Exchange and Transfer of Tickets<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.1<\/span> A exchange of Tickets after purchase for other dates, seat categories, or a return of Tickets for a refund of the purchase price is excluded (except in the event of a cancellation under Section 7.2 or an interruption under Section 7.3).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.2<\/span> Tickets are transferable. The resale of a Ticket by the consumer is permitted, provided that the resale is not carried out for commercial purposes and does not significantly exceed the original Ticket price. Admission to the Concert Event<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.1<\/span> Admission to concert events is only possible with a valid Ticket.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.2<\/span> In the event of loss of the Ticket, duplication or copying of the Ticket by the Customer, or transfer of the ticket to third parties, the Customer shall have no right to a replacement ticket or admission to the event if the Ticket has already been used by another person. The Customer is obliged to keep the Ticket secure and prevent unauthorized access by third parties. WRO is not obliged to verify the identity of the Ticket holder.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.3<\/span> If the Ticket cannot be read due to poor print quality (e.g., smudged or faded print) or technical problems with the mobile device (e.g., cracked display, empty battery), WRO reserves the right to refuse admission. The Customer shall not be entitled to a refund in such cases.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 6 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">6. Obligations of WRO regarding Concert Events<\/h2>\n<p>WRO&#8217;s obligations include admitting the Customer to the booked concert event and providing a seat in the agreed seating category. Beyond the concert performance of the concert event, WRO is under no obligation to provide tourist services, transfer services, or parking facilities.<\/p>\n<\/section>\n<p><!-- Section 7 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">7. Cancellation, Modification and Interruption of Concert Events<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">7.1<\/span> The Organizer reserves the right to make minor, necessary, and potentially short-notice changes (e.g., substitution of individual program items, substitution of performers, shortening of the duration of the performance due to unforeseen circumstances such as illness or force majeure). These changes do not entitle the Customer to return the Ticket for a refund of the purchase price or to claim damages, provided that the overall musical character of the event (e.g., \u201cClassical Concert Viennese Style in Chamber Music Arrangement\u201d) is maintained and the change is reasonable in all the circumstances.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">7.2<\/span> If the concert event is cancelled with no alternative performance offered (i.e., it does not take place and no reasonable alternative date is offered by WRO), the Customer will receive a refund of the Ticket purchase price paid. The refund will be made within 30 days of the announcement of the cancellation, to the payment account or payment method used for the original purchase. Customers will receive a notification of the refund by email. For Customers who purchased their ticket through the Webshop, the refund will be processed automatically. In the case of purchases from authorised ticket outlets, the Customer must present the original ticket (or receipt) to the Organizer within 14 days of the announcement of the cancellation or transmit a legible scanned copy by email.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">7.3<\/span> In the event of an event interruption occurring after the start of the performance, the Ticket purchase price will only be (on a pro-rata basis) refunded if less than half of the performance has been performed at the time of the interruption.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">7.4<\/span> In the event of cancellation or interruption, the Organizer will not reimburse any Customer expenses in excess of the Ticket purchase price paid. This includes, in particular, travel costs (flight, train), or accommodation costs (including hotel costs). Withdrawal for Merchandise<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.1<\/span> When purchasing merchandise in the Webshop, the Customer is entitled to the statutory right of withdrawal in accordance with Section 11 FAGG. The Customer has the right to withdraw from the contract within fourteen days without giving reasons.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.2<\/span> The period is fourteen days from the day on which the Customer or a third party named by them has received the goods. To exercise the right of withdrawal, the Customer must inform WRO of their decision by means of a clear and unequivocal statement (e.g., letter, email). To meet the deadline, it is sufficient to dispatch the declaration before the expiry of the withdrawal period. WRO recommends using the statutory model withdrawal form (available on the Website).<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.3<\/span> The right of withdrawal for merchandise is excluded in the case of:\n<ul style=\"list-style-type: disc; padding-left: 50px; margin-top: 10px;\">\n<li>Delivery of sealed audio or video recordings or computer software where the seal has been broken after delivery, where the Customer has broken the seal after delivery.<\/li>\n<li>Goods manufactured to the Customer&#8217;s specifications or clearly tailored to their personal needs (e.g., personalised souvenirs).<\/li>\n<\/ul>\n<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.4<\/span> In the event of a valid withdrawal, WRO shall refund all payments received from the Customer (including the standard delivery costs for the outward shipment) without undue delay, and in any event no later than fourteen days after receipt of the withdrawal notice. WRO may withhold the refund until it has received the returned goods or the Customer has provided conclusive evidence that the goods have been dispatched, whichever is the earlier. They establish the framework for the recurring or individual purchase of Tickets or Group Bookings by a Business Customer for resale to its end customers (Concert Visitors).<\/p>\n<p>Any terms and conditions that differ from, conflict with, or supplement these STC B2B (or the GTC) shall not apply, even if WRO does not expressly object to them or performs its services with knowledge of such terms.<\/p>\n<p>These STC B2B in addition to the GTC are originally drafted in German language and are translated and provided in English for information purposes and convenience only. WRO reserves the right to reject Ticket bookings without giving reasons or to limit them to the maximum available capacity, particularly if capacity constraints are anticipated.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.2<\/span> The Organizer\u2019s order confirmation shall be binding as to the scope of service, prices, and payment terms. Any deviations from the Business Customer\u2019s offer are marked in the order confirmation and shall be deemed a new offer by the Organizer, which the Business Customer may accept through express acceptance, payment of the purchase price, or by failing to raise an objection within 48 hours of receipt of the order confirmation.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.3<\/span> The ordered Tickets (or the confirmation of the Group Booking, where applicable) will be delivered electronically to the Business Customer after the conclusion of the contract. Prices, Payment, and Settlement<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">3.1<\/span> The agreed net prices for Tickets or Group Bookings shall apply, plus the applicable statutory value-added tax (VAT). Unless otherwise agreed, prices are in EURO (\u20ac). If payment is not made by the agreed deadline, the Business Customer shall be in default without further notice. WRO reserves the right to immediately block the affected Tickets in the event of a violation of this pricing restriction and to terminate any underlying Ticket allocation of the Business Customer with immediate effect and without notice. In this case, the Business Customer shall not be entitled to a refund.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.3<\/span> The Business Customer may only use WRO&#8217;s trademarks, logos, or protected visual materials with prior written consent and only for the promotion of Tickets purchased from WRO. Every promotional statement shall be truthful and shall not damage WRO&#8217;s reputation.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 6 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">6. Obligation of WRO at Concert Events<\/h2>\n<p>WRO&#8217;s obligations include granting the Business Customer&#8217;s end customers admission to the booked concert event and providing them with seats in the agreed seat category. Beyond the concert performance, WRO owes no additional tourist assistance, transfer services, or the provision of parking spaces.<\/p>\n<\/section>\n<p><!-- Section 8 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">8. The Business Customer is responsible for the proper handling of refunds or claims from its end customers. If a concert event must be cancelled due to external circumstances (e.g., due to force majeure, such as unforeseen closure of the venue, official prohibitions, or other operational reasons beyond WRO&#8217;s control), WRO reserves the right to charge the Business Customer a portion of the paid Ticket purchase price, with a reduction of up to 50% of the price of the booked\/reserved Tickets.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.3<\/span> The refund by the Organizer will be made within 30 days of the announcement of the cancellation, to the bank account from which payment was made. The Business Customer will be notified of the refund by email.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.4<\/span> In the event of an event interruption occurring after the start of the performance, the Ticket purchase price will only be (refunded on a pro-rata basis) refunded if less than half of the performance has been performed at the time of the interruption.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">8.5<\/span> In the event of cancellation or interruption, the Organizer will not reimburse any expenses of the Business Customer or its end customers in excess of the Ticket purchase price paid. Liability and Compensation<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">9.1<\/span> WRO&#8217;s liability is limited in accordance with the GTC. Towards Business Customers, liability is further limited to losses that are reasonably foreseeable and, in any case, to the contract value of the transaction in question. WRO&#8217;s liability for loss of profits, travel costs of end customers, and other indirect losses or pure economic loss suffered by the Business Customer or its end customers is excluded.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">9.2<\/span> Claims of the Business Customer in respect of defects in performance must be asserted in writing no later than 7 working days after the occurrence of the defect or the Business Customer&#8217;s knowledge thereof, failing which, any such claims shall be forfeited.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">9.3<\/span> The Business Customer undertakes to indemnify and hold the Organizer harmless from all claims of third parties (in particular from its end customers) arising from the Business Customer&#8217;s breach of its obligations under the contract with WRO. This also includes, if applicable, reasonable legal costs incurred by the Organizer in defending or pursuing such claims (including active defense).<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 10 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">10. This applies in particular to notices of termination, revocation, or withdrawal.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">10.2<\/span> Should individual provisions of these STC B2B or the GTC be or become invalid, the validity of the remaining provisions shall not be affected. Scope of Application<\/h2>\n<p>These STC Exclusive Concert apply in addition to the GTC for all contracts between WRO and Business Customers relating to the organisation and staging of exclusive concerts. The STC B2B shall apply to the extent not otherwise provided herein.<\/p>\n<p>Any terms and conditions that differ from, conflict with, or supplement these terms and conditions shall not apply, even if WRO does not expressly object to them or performs its services with knowledge of such terms and conditions.<\/p>\n<p>These STC Exclusive Concert in addition to the GTC and the STC B2B are originally drafted in German language and are translated and provided in English for information purposes and convenience only. In the event of any discrepancies, ambiguities, or interpretation conflicts between the German version and this translation, the German language version shall be solely authoritative and legally binding.<\/p>\n<\/section>\n<p><!-- Section 2 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">2. Subject of the Contract and Conclusion<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.1<\/span> The Organizer&#8217;s offer for an exclusive concert does not constitute a binding offer (invitatio ad offerendum). The respective contract is only concluded upon the written notice of acceptance by the Business Customer and WRO&#8217;s written confirmation thereof. Verbal ancillary agreements shall only be effective if documented in writing and confirmed by both parties.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">2.2<\/span> Under this arrangement, the Business Customer does not receive individual tickets from the Organizer, but rather the exclusive right to use the agreed venue capacity for the agreed period. Admission arrangements (including guest lists and ticketing) shall be managed by the Business Customer in coordination with the Organizer.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 3 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">3. Program and Casting Commitment<\/h2>\n<p>For an exclusive concert, the program and its structureas well as the artistic lineup are agreed upon in broad outline between WRO and the Business Customer prior to the event. The Organizer shall use its best endeavours to comply with the agreed program specifications. However, the Organizer reserves the right to make minor, necessary, and potentially short-notice program changes (e.g., substitution of individual program items, substitution of performers, shortening of the performance duration due to unforeseen circumstances such as illness or force majeure). These changes shall not entitle the Business Customer to withdraw from the contractor to claim damages, provided that the overall musical character of the event (e.g., &#8220;Classical Concert Viennese Style in Chamber Music Arrangement&#8221;) is maintained and the change is reasonable in all the circumstances.<\/p>\n<\/section>\n<p><!-- Section 4 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">4. Prices, Payment, and Cancellation<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.1<\/span> The separately agreed fixed lump sum price (including all agreed items such as room rental, artist fees, technology, and personnel) shall apply. Any additional services (e.g., additional technology, catering, extended performance times) will be charged separately on the basis of actual costs incurred.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.2<\/span> The Business Customer shall make payment in accordance with the agreed payment schedule, which typically provides for payment in instalments (e.g., a deposit of 50% of the total amount payable upon conclusion of the contract, the remaining balance due 14 days prior to the concert date). WRO shall not be obliged to perform until full payment has been received.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">4.3<\/span> If the Business Customer withdraws from the contract for the exclusive concert, the following fixed cancellation fees shall apply. Any further claims for damages (e.g., reimbursement of the Business Customer&#8217;s travel or marketing expenses) shall be excluded, unless the Organizer has acted with wilful misconduct or gross negligence.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 5 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">5. House Rights and Guest Conduct<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.1<\/span> WRO exercises house rights at the venue through its staff during the entire concert event. The GTC apply in full to all concert visitors. The Business Customer shall expressly inform the visitors of WRO&#8217;s GTC (including house rules and safety information) in a verifiable manner before they visit the concert event.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.2<\/span> The Business Customer shall be liable for the conduct of its guests, employees, and commissioned third parties (e.g., catering staff, photographers) at the exclusive concert. Violations of the house rules (e.g., smoking, disturbing the concert, carrying weapons onto the premises) by the Business Customer&#8217;s guests entitle the Organizer to (a) interrupt the exclusive concert, (b) expel any persons causing a disturbance, or (c) terminate the exclusive concert entirely if necessary.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">5.3<\/span> Access to the venue is restricted to guests and staff authorized by the Business Customer. The Organizer has the right to refuse access to third parties who are not on the guest list or are not authorized members of staff in order to ensure safety and the smooth running of the event.<\/li>\n<\/ol>\n<\/section>\n<p><!-- Section 6 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">6. Multimedia Elements of the Business Customer<\/h2>\n<p>If the Business Customer requests its own multimedia elements, projectors, or additional technology, it shall bear sole responsibility for their functionality and compatibility with the venue&#8217;s existing technical infrastructure. Any additional costs arising from such delays or failures shall be borne by the Business Customer and do not entitle the Business Customer to a reduction in the agreed price.<\/p>\n<\/section>\n<p><!-- Section 7 --><\/p>\n<section style=\"margin-bottom: 30px;\">\n<h2 style=\"font-size: 1.3em; border-bottom: 2px solid #eee; padding-bottom: 8px; color: #000;\">7. Liability and Compensation<\/h2>\n<ol style=\"list-style-type: none; padding-left: 0;\">\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">7.1<\/span> The Business Customer is liable for all damage to the venue, its equipment, and instruments, as well as for personal injury caused by the Business Customer, its employees, or its guests. This also includes damage caused by misuse of the cloakroom facilities or the use or installation of the Business Customer&#8217;s own technical equipment.<\/li>\n<li style=\"margin-bottom: 15px;\"><span style=\"font-weight: bold; display: inline-block; width: 30px;\">7.2<\/span> The Organizer shall notify the Business Customer without undue delay of any damage identified at the venue.
